Mediation

A confidential, voluntary process where a neutral third party helps both sides reach their own agreement, instead of handing the decision to a judge who met your family this morning.

Definition

What it is

Mediation is a confidential process in which a neutral mediator helps two or more people in conflict communicate effectively and build an agreement they both accept. A court can order the parties to attend, but nobody can order them to agree: the outcome stays in their hands. The mediator does not decide anything and does not represent either party.

Dr. Martinez Rodriguez is a certified mediator through Phoenix Strategies, Colorado, and has completed a master's in Mediation, Alternative Conflict Resolution and Restorative Justice through IELA/UNESCO (diploma pending). Sessions are conducted virtually, in English, Spanish, or both as the parties need.

Still deciding

You don't have to know the answer before you call.

Most people book a consultation before they're sure what they need. That's normal, not a red flag.

Benefits

Why it works

  • You control the outcome

A judge applies a statute to the facts in front of them. You and the other party can build something shaped to your actual lives: schedules, holidays, and arrangements no court would have thought to draft.

  • Confidential and private

What is said in the room stays there: no transcript, no findings that follow you into future proceedings. If the parties reach an agreement, the signed agreement itself typically becomes part of the court record once it is filed.

  • Faster and less expensive

A mediated matter often resolves faster and at lower cost than contested litigation, though the timeline and savings depend on how complex the issues are.

  • Preserves the relationship

This matters enormously when children mean you will be in contact for decades. Mediation is built around understanding rather than winning.

  • Reduces harm

Conflict usually stems from injury rather than from the issue being argued. Mediation offers a route to resolution that does not require reopening every wound to get there.

Approach

The approach

Dr. Martinez Rodriguez brings a perspective shaped by her own experience as an immigrant, a Latina, and an LGBTQ+ attorney: an understanding of how identity, culture, and trauma intersect with conflict. The aim is a culturally responsive space where both parties can speak honestly, move past blame, and reach practical terms that leave everyone's dignity intact. Early on, she works with both sides to sort what is genuinely non-negotiable from what is actually open for discussion, so the conversation stays anchored in reality rather than wishful thinking. Mediation only works when both parties negotiate in good faith; if one side is not, she will end the session rather than let it become a stalling tactic.

Good to know

An important limit

As a mediator, the firm is neutral and represents neither party. Nothing said in mediation is legal advice to either side, both parties are encouraged to have their own counsel review any agreement before signing, and the firm cannot subsequently represent either party in the same matter.

The consultation

Mediation works when both sides arrive in good faith.

Before scheduling, it is worth confirming that mediation is the right process for your situation and that both parties are genuinely prepared to negotiate. That conversation costs far less than a session that ends early.

Common questions

  • No. Consultations are paid, and that is a deliberate choice. A free consultation is generally a screening call; ours is a working session in which you receive an attorney's actual assessment of your position and options. The fee is quoted before you book, with no surprises.
